Terms and Conditions
1Scope and provider
These Terms and Conditions apply to purchases of digital greeting cards via pixelgreets.com by consumers and businesses. Mandatory statutory provisions remain unaffected.
Via pixelgreets.com, we sell only to customers whose country of residence is one of the 27 member states of the European Union. The decisive factor is the billing country given in the order.
Your contractual partner is Mosake Labs UG (haftungsbeschränkt), Eichenallee 8, 15711 Königs Wusterhausen, Germany, represented by Moritz Gellert, Saman Ali and Kevin Lippert. Contact: info@mosake-labs.com. Commercial register: Amtsgericht Cottbus (Cottbus Local Court), HRB 19658 CB.
2Digital greeting cards and technical requirements
PixelGreets offers interactive, personalisable digital greeting cards in the style of small pixel games. The subject of the purchase is the time-limited online provision of a designed card via a link that can be opened. No physical product is sent and no HTML file is sold for download.
Using the card requires a compatible, up-to-date web browser, a suitable device and an internet connection. Display and usability may vary depending on the device and browser; this does not affect the statutory requirements for digital products.
3Ordering and conclusion of the contract
Before purchasing, the buyer selects a card template and can check and correct the input fields provided and the preview. The product and the price are shown again in the purchase dialogue.
Instead of a single card, the buyer can add several designed cards to a cart. The cart is stored only in the browser used; there is no customer account. The cart shows all cards, the price per card, any promotional discount and the total price. Until the buyer continues to the Stripe checkout, cards can be changed or removed there. All cards in a cart are paid for together in one order.
Orders via pixelgreets.com are only possible for customers whose country of residence is one of the 27 member states of the European Union. Before continuing to the checkout, the buyer selects this country, which is also the country of the billing address. Orders with a country outside the European Union are not accepted. The country of the person who receives the card is not relevant.
Continuing to the secure Stripe checkout does not yet trigger any payment. The Stripe checkout is shown in English. The order with an obligation to pay is only completed in the external Stripe checkout once the payment method has been selected and confirmed. The contract is concluded when we accept the order and the payment is successfully confirmed, or when we provide the card. A confirmation is sent to the email address given when paying.
We do not make the contract text available as an individual contract record that can be retrieved via a customer account. The essential order information and the link to each card ordered are sent by email after successful payment; the legal information can be viewed on our website.
4Prices and payment
The price of a digital PixelGreets card is €4.90, a one-off total price including the applicable value added tax (VAT). The price is the same in all member states of the European Union and is charged in euros. There are no delivery costs for the digital provision. The purchase is neither a subscription nor does it renew automatically.
For orders of several cards via the cart, the promotion “Design 3 cards, pay for just 2” applies in accordance with the promotion terms at pixelgreets.com/promotion: for every three cards in the same order, one card is free. The discount is applied directly at purchase and is shown in the cart and in the Stripe checkout before payment. It is not granted later as a refund.
Payment is processed by the payment service provider Stripe. The payment methods available in each case, in particular card, where applicable Apple Pay/Google Pay, Klarna and SEPA Direct Debit, are shown in the checkout. Not every payment method is available to every customer or in every country.
For payment methods with delayed payment confirmation, in particular SEPA Direct Debit, the card is only activated once the payment service provider has confirmed receipt of the payment. A checkout session that has initially been completed is not yet proof of successful payment.
5Provision, access and duration
Once payment has been confirmed, the card is provided via a personal link, and the link is sent to the email address given at checkout. The link remains accessible for 3 calendar months from the time of successful payment and then expires automatically. It is not extended automatically.
If several cards are ordered, each card receives its own link. All cards in an order are activated together as soon as the payment has been confirmed; the access period of all cards begins at that time.
The card can be passed on by sharing the link with the intended recipients. Anyone who has the link can, in principle, open the card. For this reason, no confidential or particularly sensitive information should be included in the greeting card.
If the provision fails or the content does not conform to the contract, the statutory rights to provision and to have the lack of conformity remedied remain unaffected.
6Corrections after purchase
Within 24 hours of confirmed payment, buyers can report obvious typing errors in names or in the message for correction. An email to info@mosake-labs.com with enough details to identify the card is sufficient. Changes can only be made to the existing card content and to the extent technically provided for.
This voluntary correction offer does not limit the statutory warranty rights or any other mandatory consumer rights.
7Your own content and rights of use
Customers are responsible for the texts and other content they enter. They must not infringe the rights of third parties or distribute unlawful content via the cards. We may remove legally impermissible content or block access to such content where this is necessary and proportionate; statutory claims remain unaffected.
For the technical creation, storage and provision of the card, the person placing the order grants us the rights of use to the content they enter that are necessary for this purpose and limited to it. This does not permit any further public marketing of personal messages.
8Right of withdrawal
Consumers generally have a statutory right of withdrawal. The details, the model withdrawal form and the electronic withdrawal function can be found at pixelgreets.com/withdrawal.
For digital content for which a price is paid and which is not supplied on a tangible medium, the right of withdrawal may expire early if the statutory requirements are met: express consent to the start of performance before the end of the withdrawal period, acknowledgement of the resulting loss of the right of withdrawal, the start of performance and the provision of the required confirmation of the contract. Personalisation alone does not automatically exclude the right of withdrawal.
9Statutory rights for defects and liability
The statutory provisions on conformity with the contract, provision and remedies for defects apply to the digital products provided, in particular sections 327 et seq. of the German Civil Code (BGB). These Terms and Conditions do not restrict any mandatory rights.
Our liability is governed by the statutory provisions. In particular, claims in cases of intent and gross negligence and in cases of injury to life, body or health remain unaffected.
10Contact and final provisions
Questions, complaints and declarations can be sent to info@mosake-labs.com or by post to Mosake Labs UG (haftungsbeschränkt), Eichenallee 8, 15711 Königs Wusterhausen, Germany.
German law applies. If you are a consumer, this choice of law does not deprive you of the protection afforded to you by the mandatory consumer protection provisions of the country in which you have your habitual residence. The statutory place of jurisdiction remains unaffected.
